General Terms and Conditions

for the rental of apartments of D&T Projekt GmbH in Bonn and Meckenheim

§ 1 Scope and contracting parties

1.1 These General Terms and Conditions (Terms) apply to all contracts for the temporary provision of apartments for accommodation and to all related services concluded between D&T Projekt GmbH, Im Ruhrfeld 114, 53340 Meckenheim, Germany (hereinafter "D&T") and the guest.

1.2 In all cases, the guest's contracting party is D&T Projekt GmbH, represented by the managing directors David Demler and Tanveer Singh, registered with the Local Court (Amtsgericht) Bonn under HRB 30058.

1.3 The apartments are located in Bonn and Meckenheim. These Terms apply equally to all locations.

1.4 If the guest books via a booking platform (for example Airbnb or Booking.com), the platform's booking, payment and cancellation conditions apply in addition. In the event of conflicts, the platform's conditions take precedence for payment and cancellation. For the use of the apartment (§§ 5 to 8), these Terms apply as house rules.

1.5 Deviating terms of the guest apply only if D&T has agreed to them in advance in text form.

§ 2 Booking and conclusion of contract

2.1 The presentation of the apartments on the website, in the guest app or on platforms is not a binding offer but an invitation to book.

2.2 By submitting the booking, the guest makes a binding offer to conclude an accommodation contract. The contract is concluded when D&T confirms the booking in text form (email or message via the platform). For instant bookings, the automatic booking confirmation constitutes acceptance.

2.3 D&T may decline a booking without giving reasons as long as it has not yet been confirmed.

2.4 The guest must be of legal age at the time of booking. The guest is obliged to state the full number of accompanying persons. Only as many people may stay overnight in the apartment as stated in the booking and permitted for the apartment.

2.5 D&T reserves the right to apply customary restrictions such as minimum stays, deposits or blocked periods. These are displayed before booking.

§ 3 Prices and payment

3.1 The prices displayed at the time of booking apply. All prices are final prices in euros and include statutory VAT. Cleaning fees and other additional services are shown separately before the booking is completed.

3.2 Local taxes owed by the guest (for example an accommodation or culture tax) are shown and collected together with the booking price where D&T is obliged to collect them.

3.3 For direct bookings, the total price is due upon booking and is collected via the payment method offered (credit or debit card). Cash payment is not possible. For platform bookings, the platform's payment rules apply.

3.4 For bookings for the day of arrival, payment must be made immediately. The access code is only activated once payment has been received.

3.5 The guest receives the invoice electronically by email or for download. By booking, the guest agrees to this.

3.6 D&T may charge the stored payment method with amounts the guest owes under these Terms (for example for booked additional services, proven damage or additional cleaning). D&T informs the guest in advance in text form of the reason and the amount.

3.7 The guest may only set off claims that are undisputed or have been established by a final court decision. This does not apply to claims of the guest for defects of the apartment arising from the same contract.

§ 4 Cancellation and no-show

4.1 The cancellation conditions applicable to the booking are displayed before the booking is completed and stated in the booking confirmation. They take precedence over the following provisions.

4.2 Free cancellation is only possible if the conditions displayed at the time of booking provide for it. If they do not provide for free cancellation, the guest owes 90% of the agreed accommodation price in the event of cancellation or no-show. The cleaning fee is waived.

4.3 If D&T succeeds in renting the apartment to someone else for the cancelled period, the income generated is credited. The guest remains free to prove that D&T suffered no loss or a smaller loss.

4.4 If the guest does not arrive without cancelling, D&T may allocate the apartment to someone else from the following day. There is then no entitlement to the remaining nights.

4.5 A cancellation must be made in text form (email to kontakt@dundtprojekt.com, message via the guest app or via the platform). Receipt by D&T is decisive.

4.6 As this concerns accommodation for a specified period, there is no statutory right of withdrawal (Section 312g (2) no. 9 of the German Civil Code, BGB).

§ 5 Arrival and departure, self check-in, access codes

5.1 The apartment is available to the guest from 3:00 pm on the day of arrival. On the day of departure it must be vacated by 11:00 am.

5.2 Check-in takes place without a personal handover (self check-in). Before arrival, the guest receives a personal link and an access code for the front door and the apartment door. This requires that the booking has been paid in full and that the guest has provided the information required under § 9.

5.3 The access code is valid only for the booked period and automatically becomes invalid after check-out. The guest may not pass on the code or the link to persons who are not part of the booking.

5.4 Where keys, key cards or parking permits are issued for an apartment, they must be left at the place specified by D&T upon departure.

5.5 A later check-out can be booked via the guest app if the apartment is available on the day of departure. The price displayed there applies. An earlier check-in is only possible with prior confirmation from D&T. There is no entitlement to an earlier check-in or a later check-out.

5.6 If the guest leaves the apartment after 11:00 am without confirmation, D&T may claim the resulting loss, for example the cost of a rescheduled cleaning or a lost subsequent booking. If departure takes place more than 3 hours after check-out, D&T may charge the accommodation price for an additional night. The guest remains free to prove that no loss or a smaller loss was incurred.

§ 6 Use of the apartment and house rules

6.1 The apartment may only be used for the temporary accommodation of the persons named in the booking. Commercial use, use as a residence, photo or film recordings for commercial purposes and any unlawful use are not permitted without the prior consent of D&T.

6.2 Re-letting, subletting or passing the apartment on to third parties is prohibited. This also applies to passing on bookings at higher prices.

6.3 The guest treats the apartment, its furnishings and the common areas of the building with care, ventilates and heats appropriately, avoids heavy soiling and closes windows and doors when leaving.

6.4 The guest inspects the apartment on arrival and reports defects or damage immediately via the guest app or by message to D&T. Damage reported later is deemed to have occurred during the stay unless the guest proves that it already existed beforehand.

6.5 D&T or a commissioned service provider may enter the apartment after prior notice if this is necessary for repairs, maintenance or to avert danger. For stays of 8 nights or more, D&T may carry out a weekly interim cleaning and arrange the time with the guest. In the event of imminent danger, entry is also possible without notice.

6.6 The apartment is fitted with an electronic door lock. Tampering with the lock, smoke detectors or other safety equipment is prohibited.

§ 7 Smoking, pets, parties, quiet hours

7.1 All apartments are non-smoking apartments. Smoking is not permitted in the apartments, in the stairwell or in any common areas. This also applies to e-cigarettes, shishas and heated tobacco products. Smoking is permitted on the balcony or terrace with the door closed.

7.2 In the event of a violation of the smoking ban, D&T charges the cost of the required special cleaning and odour removal at a flat rate of €250. If D&T proves a higher loss, for example because the apartment could not be rented as a result, D&T may claim this. The guest remains free to prove that no loss or a smaller loss was incurred.

7.3 Pets are not allowed. Recognised assistance dogs are exempt upon proof. In individual cases, D&T may allow pets on request before booking. If an animal is brought without consent, D&T charges a special cleaning fee at a flat rate of €150. The guest remains free to prove that no or a smaller expense was incurred.

7.4 Parties, celebrations and gatherings with persons who are not part of the booking are not permitted. Quiet hours from 10:00 pm to 7:00 am must be observed. Consideration for neighbours is also required during the day, as the apartments are located in residential buildings.

7.5 In the event of parties or significant noise disturbances, D&T may charge a special cleaning fee and the additional expense at a flat rate of €300; D&T reserves the right to claim a higher proven loss, and the guest remains free to prove the contrary.

7.6 Sensors may be used in the apartments that measure noise levels, detect smoke or record the number of connected devices. These sensors do not record conversations or images. There are no cameras in the apartments.

7.7 In the event of a serious or repeated violation of §§ 6 and 7, D&T may terminate the contract without notice in accordance with § 12.

§ 8 Damage, cleaning, keys and access codes

8.1 The guest is liable for damage to the apartment, its furnishings and the common areas culpably caused by the guest, accompanying persons or visitors. Normal wear and tear is excluded.

8.2 If inventory is missing or damaged upon departure, D&T charges the cost of replacement or repair. If the apartment cannot be rented as a result, D&T may also claim the proven loss of income.

8.3 If the guest leaves the apartment significantly dirtier than with normal use (for example large amounts of unwashed dishes, stains, rubbish outside the bins, food leftovers), D&T charges the additional cleaning expense, at least €50. The guest remains free to prove that the additional expense was lower.

8.4 If the guest loses or fails to return an issued key, key card or parking permit, D&T charges a flat rate of €40 for the replacement. If a lock has to be replaced for security reasons, D&T may claim the proven costs for this.

8.5 If the guest passes on the access code to unauthorised persons, the guest is liable for the resulting damage.

8.6 For each case of damage that D&T has to settle with the guest, D&T may charge a handling fee of €25. Here too, the guest remains free to prove that the expense was lower.

8.7 D&T documents damage and soiling with photos and informs the guest in text form within 7 days of departure.

§ 9 Guest data, registration obligation, identity verification

9.1 When booking, the guest provides their full name, address, a valid email address and a mobile number. D&T needs this information to transmit the access code and to reach the guest during the stay.

9.2 Under the German Federal Registration Act, every guest must complete a registration form on the day of arrival. This is done digitally via the check-in link. Foreign guests additionally provide the number of their identity card or passport. The registration form is retained for the statutory periods and then deleted.

9.3 Before activating the access code, D&T may require verification of identity, for example by means of a photo of the ID via the check-in link. The data is used only for this purpose and deleted after the stay unless there is a legal retention obligation.

9.4 If the guest's identity cannot be established or the guest provides evidently false information, D&T may decline the booking or withdraw from the contract. Payments already made are refunded unless D&T has suffered a loss.

9.5 For direct bookings, D&T uses software that screens bookings for signs of fraud (for example unusual combinations of payment method, address and email address). If a booking is flagged as suspicious, D&T may request additional proof or decline the booking.

§ 10 Liability of D&T

10.1 D&T is liable without limitation for damage resulting from injury to life, body or health and for damage based on intent or gross negligence on the part of D&T, its legal representatives or vicarious agents.

10.2 In the event of slight negligence, D&T is liable only for the breach of a material contractual obligation, i.e. an obligation whose fulfilment is essential for the proper performance of the contract and on whose observance the guest may rely. In this case, liability is limited to the foreseeable damage typical of the contract.

10.3 Liability under the German Product Liability Act remains unaffected.

10.4 D&T is liable for items brought in by the guest in accordance with the statutory provisions (Sections 701 et seq. BGB). Money, securities and valuables should not be left unattended in the apartment. The guest reports loss or damage to D&T immediately.

10.5 If D&T provides a parking space or underground parking space, this does not constitute a custody agreement. D&T does not monitor the parking space. D&T is liable for damage to the vehicle or its contents only in accordance with 10.1 and 10.2.

10.6 The guest reports faults or defects immediately via the guest app or by message so that D&T can remedy them. The guest cooperates to a reasonable extent in remedying the fault and keeping damage to a minimum.

10.7 D&T keeps lost property for 3 months. On request, D&T will send it against reimbursement of the shipping costs. After that it is disposed of or donated.

§ 11 Wi-Fi use

11.1 D&T provides the guest with internet access via Wi-Fi in the apartment. A specific bandwidth or constant availability is not owed. Disruptions caused by the provider, maintenance work or force majeure are possible.

11.2 The guest uses the access only within the limits of the law. In particular, downloading or distributing copyrighted content via file-sharing networks, illegal streaming services and accessing or distributing criminal content are prohibited.

11.3 The guest indemnifies D&T against third-party claims based on unlawful use of the access by the guest or by persons to whom the guest has given access. This also includes the reasonable costs of legal defence.

11.4 The Wi-Fi password may not be passed on to persons outside the booking. In the event of legal violations, D&T may block access.

§ 12 Termination for good cause

12.1 D&T may terminate the contract without notice for good cause. Good cause exists in particular if

  1. the guest violates the smoking ban, the party ban, the quiet hours or the permitted number of persons despite a warning; in the event of serious violations, a warning is not required,
  2. the guest re-lets the apartment or uses it commercially or unlawfully contrary to § 6,
  3. the guest made the booking using false information about their identity, their ability to pay or the purpose of the stay,
  4. the guest endangers or significantly damages the apartment, its furnishings or other residents of the building,
  5. force majeure or other circumstances for which D&T is not responsible make the provision of the apartment impossible (for example water damage or an official ban on use).

12.2 D&T notifies the guest of the termination in text form. In the cases of 12.1 nos. 1 to 4, the guest must vacate the apartment immediately; the access code is deactivated. There is no entitlement to a refund of the price for the unused nights insofar as the guest is responsible for the termination. D&T credits saved expenses and income from renting the apartment to someone else.

12.3 In the case of 12.1 no. 5, D&T refunds the price for the unused nights and endeavours to find a replacement apartment. Further claims of the guest are governed by § 10.

12.4 If D&T has terminated for a reason for which the guest is responsible, D&T may also cancel already confirmed future bookings of this guest. Amounts paid for these bookings are refunded.

§ 13 Data protection

13.1 D&T processes the guest's data to perform the contract, to comply with the registration obligation and to communicate during the stay. Details, the legal bases and the guest's rights are set out in the Privacy Policy.

13.2 To manage bookings and send messages, D&T uses a property management system and a guest app. The providers are contractually bound as processors.

13.3 Data that a guest transmits via a platform is processed by the platform in accordance with its privacy policy. D&T only receives from the platform the data required for the booking.

§ 14 Final provisions

14.1 Amendments and additions to the contract must be made in text form. This also applies to any amendment of this clause.

14.2 The law of the Federal Republic of Germany applies. For consumers habitually resident abroad, mandatory protective provisions of their home country remain unaffected.

14.3 If the guest is a merchant, a legal entity under public law or has no general place of jurisdiction in Germany, the place of jurisdiction is the registered office of D&T in Meckenheim. For consumers, the statutory places of jurisdiction apply.

14.4 D&T is neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.

14.5 Should any provision of these Terms be or become invalid, the remaining provisions remain valid. The invalid provision is replaced by the statutory provisions.

14.6 These Terms apply to bookings made from the date of their publication on www.dundtprojekt.com. For earlier bookings, the version valid at the time of booking applies.

14.7 These Terms are a convenience translation of the German "Allgemeine Geschäftsbedingungen". In case of discrepancies or questions of interpretation, the German version applies.
